Nkuko mwabyumvise mu makuru atandukanye ku maradiyo,amatereviziyo ndetse no mu binyamakuru byandikwa no kumbuga nkoranyambaga, Leta y'agatsiko gato ka FPR iyobojeu Rwanda igitugu imaze igihe kirekire ishakisha uburyobwose yabuza amahoro abantu bayihunze. Uretse, abicwa kuburyo butandukanye harimo no kugerageza gusaba ibihugubyabahaye ubuhungiro ngo bibirukane.

Nyuma yo gukama ikimasa aho Leta ya Paul Kagameyagerageje gahunda yo kwambuza ubuhungiro uwitwa umunyarwanda uwo ariwe wese, iyo gahunda yagombaga kurangirana n'umwaka w' 2012, maze ngo mu kwezi kwa (6)ariko kwa Kamena2013, abanyarwanda bakaba baramaze gutaha, abadatashye bakaba ngo baramaze guhabwa ubwenegihugu bw'amahanga. 

Ubu aho mvugira aha ngahaturasatira isoza rya 2014, ariko iyo gahunda yiswe Cessation Clause yaribagiranye burundu (yagiye nk'ifuni ihese cyangwa se nk'amahembe y'imbwa nk'uko babivuga mu Kinyarwanda.

General Kayumba Nyamwasa, n'ubwo kumwambuza ubuhungiro itari yo ntego y'ibanze ya Paul Kagame, ahubwo we yifuzaga kumwica n'ubwo yabigerageje inshuro 4 zose nabwo akama ikimasa, ku rundi ruhande yageragezaga no gutanga amafaranga atagira umubare ngo ashake abamufasha kwirukanisha General Kayumba Nyamwasa mu gihugu cyamwakiriye!!!

Ni muri urwo rwego, Leta ya Paul Kagame yifashishije ambasade yayo cyane uwitwaga Didier Rutembesa banyanyagije amafaranga mu mpuzamiryango iharanira uburenganzira bw'impunzi n'abimukira mu gace k'amajyepfo y'Afrika.

Tukiri muri Afrika y'Epfo reka tubageze itangazo rigenewe abanyamakuru ryasohowe n'umuryango wa General Kayumba Nyamwasa nyuma y'uko urukiko rw'ikirenga rutesheje agaciro ikirego cya CORMSA.

Itangazo ryari mu rurimi rw'icyongereza riragira riti:

Urubanza CORMSA yaregagamo Perezida w´Afrika y'Epfo, General Kayumba Nyamwasa n'abandi.

Kuri uyu munsi taliki 26 Nzeri 2014, urukiko rw'ikirenga i Pretoria rwasezereye ikirego cyatanzwe na CORMSA (impuzamiryango irengera impunzi n'abimukira mu majyepfo y'Afrika) cyaregaga guverinoma y'Afrika y'Epfo na General Kayumba Nyamwasa ruvuga ko nta shingiro gifite.

Urukiko ruti: "ikirego nta gaciro, nta n'ishingiro kuko cyitwazaga amakuru y'ibinyoma arega General Kayumba ibyaha batabashije kubonera ibimenyetso imbere y'umucamanza".

Umucamanza yavuze ko icyemezo cyafashwe n'urukiko rwa gisirikare mu Rwanda cyo guhamya General Kayumba ibyaha adahari nacyo kidafashije kandi kitafatwa nk'ishingiro rihamye.

Umucamanza yanavuze ko kuba inkiko z'ubufaransa na Espagne zaba zishaka kuburanisha General Kayumba Nyamwasa kubera ibyaha by'intambara akekwakwaho,umucamanza ati:" ibi ntibyashingirwaho nk'impamvu z'ingenzi ngo General Kayumba abe yajyanwa muri ibyo bihugu cyangwa se ngo bitume yimwa ubuhungiro nk'impunzi ya politiki".

 

Umucamanza yasanze nta mpamvu zakwambuza General KayumbaNyamwasa ubuhungiro haba mu mategeko y'Afrika y'Epfo cyane cyane mu gika cya 4 cy'itegeko rirebana n'iby'impunzi ryo mu 1998 cyangwa se mu masezerano y' umuryango w'abibumbye UN/ ONU yo mu 1951, hamwe n'amasezerano y'umuryango w'ubumwe bw'Afrika AUO/OUA yo mu 1969 mu bibazo birebana n'impunzi.

 

Umucamanza yasanze Guverinoma y'Afrika y'Epfo yarasuzumanye ubushishozi igasanga nta mpamvu yemeza ko General Kayumba Nyamwasa yaba yarakoze ibyaha byavuzwe mu gihe nta bimenyetso byagaragajwe.

 

Urukiko rwabonye ibi bikurikira mu mikirize y'urubanza:

b Ko Ubuzima bwa General Kayumba Nyamwasa buri mu makuba nta kubishidikanyaho kuva aho hagaragariye ubwumvikane buke hagati ye na General Kagame, Perezida w'u Rwanda. Ibi bikaba byaramugize umwe mu batavuga rumwe n'ubutegetsi buriho

Kubera ziriya mpamvu zose zavuzwe umucamanza yafashe umwanzuro wo gusesa ikirego.

PRESS RELEASE:

 CORMSA VS THE PRESIDENT OF RSA AND GENERAL KAYUMBA NYAMWASA & OTHERS

On this day the 26^th/09/2014 the Pretoria High Court in Pretoria dismissed the application brought by CORMSA (Consortium for Refugees and migrants in South Africa) against the Government of South Africa and General Kayumba Nyamwasa as baseless and unfounded and with costs.

The application was found to be baseless and unfounded, but informed by false allegations that Gen Kayumba committed crimes which they failed to prove to the Judge as they alleged.

The Judge further found that the Rwandan military court's decision of guilty in absentia to be irrelevant and cannot be relied on or be taken serious.

The Judge found that the indictment by both French and Spanish courts on allegations of war crimes, to be unsubstantiated and to be mere allegations and therefore no reasonable grounds that he must be extradited to those respective countries or to be excluded as a political refugee.

The Judge found that there was no reason for exclusion as a refugee in terms of both South African law specifically Sec 4 of the refugees Act 1998 and under UN Convention of 1951 read together with the OAU Convention of 1969 and its protocol on refugees.

The Judge found that the South African Government did consider all the allegations and indeed correctly found that there was no reason to believe that Gen Kayumba Nyamwasa committed these crimes in the absence of any evidence to that effect.

The Court noted the following in its Judgment;

1.      That General Kayumba's life was in danger and that there was no dispute about it, since his fallout with General Kagame President of Rwanda and became his political opponent.

2.      That there where many attempts on his life by the Govt of Rwanda.

3.      That the Government of South Africa was aware of the allegations and considered them,

4.      That  the indictment by French Judge Bruguiere was declared by new investigative Judges Trevidic and Nathalia Poux to be false.

5.      That this court could not consider the Spanish indictment because it was based on Judge Bruguiere's findings which were found to be false.

6.      That General Kayumba was correctly granted political refugee by South African Government in terms of both national and international law.

Therefore, the court dismissed the application with costs.
